Richard Wayne Conklin of Great Falls has been arrested and is facing charges of rape and sexual assault.
Conklin, 42 years old, was arrested on Tuesday, January 14, 2020.
According to the Cascade County Detention Center, Conklin is being held on the following three felony charges:
- 45-5-503 - Sexual Intercourse Without Consent
- 45-5-502(1) - (F) Sexual Assault
- 45-5-502(1) - (F) Sexual Assault
Court documents for the charge for sexual assault state that Conklin "knowingly subjected another person...to sexual contact without consent. The victim is less than 16 years old."
Court documents for the charge of sexual intercourse without consent state that Conklin "knowingly had sexual intercourse without the consent" of the victim.
According to Montana Code 45-5-501 , consent to sexual intercourse can not be given by people who are:
- (i) mentally disordered or incapacitated;
- (ii) physically helpless;
- (iii) overcome by deception, coercion, or surprise;
- (iv) less than 16 years old;
