Approximately two years ago, some pictures surfaced showing a horse with a missing hoof and a calf lying in feces at a Bozeman arena appeared online.
Soon after, the owner of the arena, Dayle Kountz, was charged with animal cruelty.
The case has still not been resolved but a new court date has been set.
In May of 2015, Kountz, the owner of Kountz arena on Stucky Road was charged with three felony counts of animal cruelty.
The case against Kountz started when the pictures emerged after a horse show at Kountz Arena on March 28th of 2015.
The images show a horse named Young Doc Bar with a bloody stump.
Gallatin County Sheriff's Deputies began investigating the case after an anonymous call.
Kountz told the investigating deputy that Young Doc Bar injured his foot a few months earlier. The foot had fallen off and Kountz said he was keeping the horse alive to get semen for breeding.
The horse was eventually put down.
Now, Kountz’ lawyers have filed two motions, one asking for witness immunity, the other asking for a change of venue, meaning he would be tried outside of Gallatin County.
The motion notes that because of media coverage "Dayle cannot receive a fair trial before an impartial jury in Gallatin County."
The motion mentions convicted fugitive Kevin Briggs and convicted killer Cody Little - both of whom received extensive media coverage and were tried and convicted in Gallatin County.
A hearing on both motions is set for April 6th.
